1. INTRODUCTION AND ACCEPTANCE
1.1 These Terms and Conditions ("Terms") constitute a legally binding agreement between the individual/entity registering as a property owner ("Client", "you", "your") and View on Click LLP, a Limited Liability Partnership incorporated under the Limited Liability Partnership Act, 2008, having its registered office at B-806, Tower-4, NX One, Techzone-IV, Greater Noida West, Uttar Pradesh 201306 ("VOC", "we", "us", "our", "Platform").
1.2 By clicking "I Accept" / creating a login ID, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any other policies referenced herein.
1.3 If you do not agree to these Terms, you must not register on or use the Platform.
2. ELIGIBILITY
2.1 You must be at least 18 years of age and legally competent to enter into a contract under the Indian Contract Act, 1872.
2.2 You represent that you are the lawful owner of the property listed, or are duly authorized (by way of Power of Attorney, family consent, or otherwise) to list, showcase, and market the said property on the Platform.
2.3 The VOC reserves the right to verify ownership/authorization documents at any stage and to suspend or remove a listing pending such verification.
3. ACCOUNT REGISTRATION
3.1 You are required to create a unique login ID and password to access the Platform's services.
3.2 You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
3.3 You agree to provide accurate, current, and complete information during registration and to update the same promptly if it changes.
3.4 The VOC is not liable for any loss or damage arising from your failure to comply with the above security obligations.
4. NATURE OF SERVICES
4.1 The Platform enables you to:
- List your property (residential/commercial, as applicable) for marketing purposes;
- Avail paid photography, videography, and/or drone footage services performed by VOC-appointed or VOC-affiliated photographers/videographers ("Service Provider");
- Receive a unique "Subscription ID" / listing reference linked to your property, which you may share with prospective buyers/tenants ("Prospects");
- Enable Prospects to book a live virtual tour of your property, to be conducted by a VOC videographer at a mutually convenient slot.
4.2 The VOC acts as a facilitator/aggregator connecting Clients, Prospects, and Service Providers. The VOC does not act as a real estate broker, agent, or valuer, and does not guarantee any sale, purchase, lease, or transaction outcome in respect of the listed property.
4.3 The VOC does not verify, endorse, or guarantee the accuracy of title, ownership, encumbrance status, or legal compliance of any listed property. Clients are solely responsible for the accuracy and legality of the information and documents provided.
5. FEES AND PAYMENT
5.1 Charges for photography, videography, and drone footage services shall be as displayed on the Platform at the time of booking, and are subject to change with prior notice.
5.2 Full or partial payment (as specified at checkout) must be made in advance to confirm a shoot booking. The visit by the photographer/videographer will be scheduled only upon receipt of payment.
5.3 All payments are processed through third-party payment gateways. The VOC is not responsible for any failure, delay, or error caused by such gateways.
5.4 GST and other applicable taxes shall be charged extra, as applicable under law.
5.5 Cancellation & Refund: Cancellations made more than 24 hours before the scheduled shoot may be eligible for a full refund; cancellations thereafter, or a "no-show" by the Client at the property, may be non-refundable.
6. PROPERTY VISIT AND CONTENT CREATION
6.1 The Client shall ensure safe, unobstructed, and timely access to the property for the Service Provider at the scheduled slot.
6.2 The Client shall ensure the property is reasonably presentable and that no illegal, hazardous, or unsafe condition exists at the site. The VOC and its Service Providers reserve the right to refuse or discontinue a shoot if they reasonably believe the premises are unsafe.
6.3 Drone footage shall only be captured where permitted under applicable law (including DGCA regulations and any local/housing society restrictions). It is the Client's responsibility to obtain any necessary permissions (including from the Resident Welfare Association/Society/neighbours) for drone operation; the VOC shall not be liable for denial of such permission or consequences of unauthorized drone use initiated at the Client's request.
6.4 Turnaround time for editing and uploading content shall be communicated at the time of booking and is an estimate, not a guarantee.
7. CONTENT OWNERSHIP AND LICENSE
7.1 All photographs, videos, and drone footage created for the Client's listing ("Content") shall, upon full payment, be owned by the Client.
7.2 The Client grants the VOC a non-exclusive, royalty-free, worldwide license to host, display, stream, and share the Content on the Platform, and (unless the Client opts out in writing) to use the Content for the VOC's own promotional and marketing purposes.
7.3 The Client shall not use the Content in a manner that is misleading, defamatory, or unlawful, or for any property other than the one shot.
7.4 The Client warrants that they have the right to allow such content to be created and shared, and shall indemnify the VOC against any third-party claims (e.g., from co-owners, tenants, or occupants) arising from unauthorized creation or sharing of Content.
8. LISTING AND SUBSCRIPTION ID
8.1 Upon successful listing, the Client will receive a unique Subscription ID, which may be shared with Prospects for viewing the listing and initiating a live tour booking.
8.2 The Client is responsible for ensuring the Subscription ID is shared only with genuine, interested parties and agrees not to misuse the referral/sharing mechanism for spam or unauthorized commercial purposes.
8.3 The VOC reserves the right to deactivate a Subscription ID/listing in case of misuse, non-payment, incorrect information, or upon the Client's request, or if the property is sold/let out/withdrawn.
9. LIVE TOUR BOOKINGS BY PROSPECTS
9.1 The Client acknowledges that live virtual tours are conducted by VOC videographers based on slots booked by Prospects and agrees to keep the property reasonably accessible during the active listing period, or to promptly inform the VOC of any change in availability.
9.2 The VOC shall not be liable for any missed, delayed, or cancelled live tour caused by the Client's unavailability or failure to grant access.
10. PROHIBITED CONDUCT
The Client shall not:
- list a property they do not own or are not authorized to list;
- provide false, misleading, or incomplete information;
- use the Platform for any fraudulent, illegal, or unauthorized purpose;
- attempt to bypass the Platform to solicit direct transactions with Prospects introduced through the Platform in a manner that violates the VOC's commercial terms (if applicable, as separately agreed).
11. LIMITATION OF LIABILITY
11.1 The Platform, Content hosting, and related services are provided on an "as is" and "as available" basis.
11.2 The VOC shall not be liable for any indirect, incidental, consequential, or special damages, including loss of a sale/deal, arising from use of the Platform.
11.3 The VOC's aggregate liability for any claim arising out of these Terms shall not exceed the amount paid by the Client for the specific service giving rise to the claim.
12. DATA PRIVACY
12.1 Personal information and property details provided by the Client shall be processed in accordance with the VOC's Privacy Policy and applicable data protection laws, including the Digital Personal Data Protection Act, 2023.
13. TERM AND TERMINATION
13.1 These Terms remain effective as long as the Client maintains an active account/listing.
13.2 The VOC may suspend or terminate a client’s account for breach of these Terms, non-payment, fraudulent activity, or at its reasonable discretion with notice.
13.3 The Client may request account/listing deletion at any time, subject to completion of any pending bookings/payments.
14. INDEMNITY
The Client agrees to indemnify and hold harmless the VOC, its partners, employees, and Service Providers from any claims, losses, damages, or liabilities arising from the Client's breach of these Terms or violation of any applicable law.
15. GOVERNING LAW AND DISPUTE RESOLUTION
15.1 These Terms shall be governed by the laws of India, having jurisdiction at Noida.
16. AMENDMENTS
The VOC reserves the right to amend these Terms at any time. Continued use of the Platform after such changes constitutes acceptance of the revised Terms.

1. INTRODUCTION AND ACCEPTANCE
1.1 These Terms and Conditions ("Terms") govern the use of the View on Click platform ("Platform") by any individual browsing property listings and/or booking a live virtual property tour ("Prospect", "you", "your"), offered by View on Click LLP ("VOC", "we", "us", "our").
1.2 By clicking "I Accept" or by subscribing/booking a slot using a Subscription ID, you agree to be bound by these Terms and our Privacy Policy.
2. ELIGIBILITY
2.1 You must be at least 18 years of age and legally competent to contract to use the Platform's paid services.
3. NATURE OF SERVICES
3.1 The Platform allows you to enter a Subscription ID shared by a property owner ("Client") to view photographs, videos, and drone footage of a listed property.
3.2 If you wish to view the property "live," you may subscribe/pay the applicable fee and book a slot for a live virtual tour, which will be conducted by a VOC-appointed videographer physically present at the property, streaming/showing the property to you in real time (e.g., via video call).
3.3 The VOC is only a technology and service facilitator. We are not a real estate broker, agent, valuer, or party to any sale/purchase/rental transaction. We do not verify or guarantee:
- the ownership, title, or legal status of the property;
- the accuracy of the size, price, amenities, or any description provided by the Client;
- the outcome, genuineness, or safety of any subsequent transaction between you and the Client.
3.4 Any decision to engage further with a client (including site visits, negotiations, or purchase/rental) is made entirely at your own discretion and risk. We strongly recommend independent legal and title due diligence before entering into any transaction.
4. ACCOUNT AND SUBSCRIPTION
4.1 You may be required to create a login ID and password to access certain features. You are responsible for maintaining confidentiality of your credentials.
4.2 You agree to provide accurate contact information (name, phone number, email) so that our videographer/team can coordinate the live tour slot with you.
5. FEES AND PAYMENT
5.1 Live tour bookings are chargeable as per the fee displayed at the time of booking. Payment must be completed to confirm your slot.
5.2 All payments are processed via third-party payment gateways; the VOC is not responsible for gateway errors, delays, or failures.
5.3 Cancellation & Refund: Cancellations made 24 hours before the scheduled slot may be refunded/rescheduled; last-minute cancellations, no-shows, or Client-side unavailability may be handled as per the refund policy displayed at checkout.
5.4 If a scheduled live tour cannot be conducted due to reasons attributable to the Client (e.g., property inaccessible, owner unavailable) or the VOC (e.g., videographer unavailability), you shall be offered a rescheduled slot or refund, as applicable, in accordance with our refund policy.
6. CONDUCT DURING LIVE TOUR
6.1 You agree to join the scheduled live tour slot on time and to conduct yourself courteously with the videographer.
6.2 You shall not use the live tour session to record, screenshot, or redistribute the video stream for any commercial purpose without the Client's and VOC's consent, other than for your personal evaluation of the property.
6.3 You shall not use abusive, threatening, or inappropriate language or behaviour towards the videographer or VOC staff. The VOC reserves the right to terminate a session and/or your account in case of such conduct.
7. NO GUARANTEE OF AVAILABILITY
7.1 The VOC does not guarantee that a property will remain available, unsold, or unlet at the time of your inquiry or booking, as listings are controlled and updated by the respective Client.
8. DATA PRIVACY
8.1 Your personal information will be shared with the relevant Client (to facilitate coordination of the live tour and any follow-up) and processed in accordance with our Privacy Policy and applicable data protection laws, including the Digital Personal Data Protection Act, 2023.
8.2 You consent to being contacted by the VOC and/or the relevant Client via call, SMS, WhatsApp, or email for purposes connected with your inquiry/booking.
9. PROHIBITED CONDUCT
You shall not:
- impersonate another person or provide false contact/identity information;
- use the Platform to harass, stalk, or send unsolicited communications to any Client or Service Provider;
- misuse a Subscription ID that was not shared with you by an authorized Client;
- use bots, scrapers, or automated means to access listings or Platform data.
10. LIMITATION OF LIABILITY
10.1 The Platform and its content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
10.2 The VOC shall not be liable for any loss, damage, or dispute arising from:
- inaccurate information provided by a Client;
- any transaction, negotiation, or dealing you enter into with a Client;
- any loss suffered due to reliance on photographs/videos/live tour content.
10.3 The VOC's aggregate liability, if any, shall not exceed the amount paid by you for the specific booking giving rise to the claim.
11. INDEMNITY
You agree to indemnify the VOC against any claims or losses arising from your breach of these Terms, misuse of the Platform, or unlawful conduct.
12. GOVERNING LAW AND DISPUTE RESOLUTION
12.1 These Terms shall be governed by the laws of India having jurisdiction at Noida.
13. AMENDMENTS
The VOC may amend these Terms at any time; continued use of the Platform constitutes acceptance of the updated Terms.

1.2 By clicking "I Accept" and completing registration, you agree to be bound by these Terms.
2. NATURE OF RELATIONSHIP
2.1 You are engaged by the VOC as an independent contractor / gig service partner for the specific assignments accepted by you through the Platform. Nothing in these Terms shall be construed as creating an employer-employee relationship, partnership, agency, or joint venture between you and the VOC.
2.2 You shall be responsible for your own tax filings, including GST registration (if applicable/required by law) and income tax, in respect of payments received from the VOC. The VOC shall deduct TDS as required under applicable law.
2.3 You are free to accept or decline specific assignments offered through the Platform, subject to the service-level expectations in these Terms.
3. ELIGIBILITY AND ONBOARDING
3.1 You must be at least 18 years of age, and must possess the necessary skill, equipment (camera/videography equipment, and where applicable, a drone), and any licenses/permits required to lawfully carry out such services, including a valid drone pilot license/UIN-UAOP registration (as applicable under DGCA/Digital Sky regulations) if you undertake drone shoots.
3.2 You agree to submit true and accurate documents (identity proof, address proof, equipment details, drone license where applicable, bank details) for verification and onboarding purposes.
3.3 The VOC reserves the right to verify your credentials, conduct background checks, and reject or terminate your registration at its discretion.
4. SCOPE OF SERVICES
4.1 Upon accepting a booking assigned through the Platform, you agree to:
- visit the specified property at the scheduled date/time;
- capture photographs, videos, and/or drone footage as per the VOC's specified quality/format guidelines;
- upload the raw/edited Content to the Platform within the agreed turnaround time;
- where assigned, conduct a live virtual tour of the property for a Prospect at the scheduled slot, using the VOC's designated app/tool.
4.2 You agree to maintain punctuality, professional conduct, and courteous behaviour with Clients and Prospects at all times.
4.3 You shall carry valid identification and, if provided, a VOC identity card/badge, when visiting a Client's property.
5. EQUIPMENT AND SAFETY
5.1 You are responsible for maintaining your own equipment in good working condition and in compliance with applicable safety standards.
5.2 Drone operations must strictly comply with DGCA regulations, no-fly zone restrictions, and any permissions required from local authorities, housing societies, or property owners. You are solely responsible for obtaining and carrying proof of such compliance/permissions during a shoot. The VOC shall not be liable for any penalty, seizure, or legal action arising from unauthorized or non-compliant drone operation by you.
5.3 You shall exercise due care to avoid damage to the Client's property, persons, or belongings during a shoot. Any damage caused due to your negligence shall be your responsibility, and the VOC reserves the right to recover related costs from you and/or terminate your engagement.
6. CONTENT OWNERSHIP AND CONFIDENTIALITY
6.1 All photographs, videos, and drone footage captured by you during an assignment are considered "work made for hire" and shall be owned by the VOC (and, per the VOC's arrangement with the Client, licensed to the relevant Client), unless otherwise agreed in writing. You waive any claim of ownership or right to independently use, sell, or distribute such Content.
6.2 You shall not retain, copy, publish, or share any Content, or any personal/property information of a Client or Prospect, for personal or commercial purposes without the VOC's prior written consent.
6.3 You agree to keep confidential all information regarding Clients, Prospects, property details, and the VOC's business operations, both during and after your engagement with the Platform.
7. PAYMENT
7.1 You shall be paid per assignment/booking completed, at the rates communicated by the VOC at the time of assignment or as per the applicable rate card.
7.2 Payments shall be made to your registered bank account within the timeline specified by the VOC (e.g., [X] days from satisfactory completion and upload of Content), subject to applicable TDS deductions.
7.3 No payment shall be due for incomplete, low-quality (not meeting the VOC's specified standards), or unauthorized/cancelled assignments, except as otherwise determined by the VOC at its discretion.
7.4 In case of a Client/Prospect cancellation after you have reported to the property or commenced travel, you may be eligible for a cancellation/inconvenience fee as per the VOC's policy, communicated separately.
8. CONDUCT DURING LIVE TOURS
8.1 While conducting a live virtual tour, you shall represent the property fairly and shall not make false, exaggerated, or misleading statements regarding the property to the Prospect.
8.2 You shall not solicit, negotiate, or accept any payment directly from a Client or Prospect for services outside the Platform, or attempt to bypass the Platform for future bookings with a Client/Prospect met through the Platform (non-circumvention).
9. NON-CIRCUMVENTION AND NON-SOLICITATION
9.1 During your engagement with the Platform and for a period of [12] months thereafter, you shall not directly or indirectly solicit or contract with any Client or Prospect introduced to you through the Platform for similar services outside the Platform.
9.2 Breach of this clause may result in immediate termination and legal action for damages.
10. PROHIBITED CONDUCT
You shall not:
- misrepresent your identity, skills, or credentials;
- engage in any unsafe, illegal, or unauthorized activity while representing the VOC;
- behave inappropriately, harass, or misuse the personal information of any Client or Prospect;
- use VOC-issued access, tools, or Content for any unauthorized purpose.
11. TERMINATION
11.1 The VOC may suspend or terminate your registration at any time, with or without cause, including for breach of these Terms, repeated cancellations, poor quality of service, or complaints from Clients/Prospects.
11.2 You may terminate your engagement at any time by providing written notice to the VOC, subject to completion of any assignments already accepted.
12. LIMITATION OF LIABILITY AND INDEMNITY
12.1 You agree to indemnify and hold harmless the VOC from any claims, damages, or liabilities arising from your negligence, misconduct, breach of these Terms, or violation of applicable law (including drone regulations) while performing services.
12.2 The VOC's liability towards you shall be limited to unpaid fees for satisfactorily completed assignments.
13. DATA PRIVACY
13.1 Any personal data of Clients/Prospects accessed by you in the course of an assignment shall be used strictly for performing that assignment and handled in accordance with the VOC's Privacy Policy and applicable data protection laws, including the Digital Personal Data Protection Act, 2023.
14. GOVERNING LAW AND DISPUTE RESOLUTION
14.1 These Terms are governed by the laws of India, subject to arbitration under the Arbitration and Conciliation Act, 1996, seated at [insert city], or the exclusive jurisdiction of courts at [insert city].
15. AMENDMENTS
